Cancellation Policy for Purchase Options
LusoTerroir – Wine Club
This Cancellation Policy establishes the conditions applicable to purchase options offered by LusoTerroir, in accordance with current Portuguese legislation, namely Decree-Law No. 24/2014, of February 14.
1. Cancellation before shipment
The customer may request the cancellation of their purchase option at any time until the order is shipped, free of charge.
The request must be made in writing, through LusoTerroir's official contacts, indicating the order number.
2. Cancellation after shipment
After the order has been shipped, cancellation is no longer possible, and the right of free withdrawal applies, where applicable, in accordance with the law.
3. Right of Withdrawal (Decree-Law 24/2014)
In accordance with articles 10 et seq. of Decree-Law No. 24/2014, the customer has a period of 14 consecutive days, from the date of receipt of the products, to exercise the right of withdrawal, without needing to state a reason.
To exercise this right, it is necessary that:
The bottles are sealed, unopened and unused;
The products are in perfect condition;
The original packaging is complete.
The customer must communicate their decision to withdraw in writing, through an unequivocal statement.
4. Return Costs
In accordance with the law, the direct costs of returning the goods are the responsibility of the customer, except when:
LusoTerroir has assumed responsibility for these costs; or
The return results from an error, defect or non-conformity attributable to LusoTerroir.
5. Exclusions to the Right of Withdrawal
According to Article 17 of Decree-Law 24/2014, the right of withdrawal does not apply to:
Customized products or products prepared according to customer specifications;
Bottles of wine that have been opened after delivery, for reasons of health protection or hygiene;
Products clearly identified as non-refundable, when legally permitted.
6. Refunds
In the event of a valid contract termination, LusoTerroir will refund the amounts paid within a maximum of 14 days after receiving the termination notice, and may withhold the refund until receipt of the returned goods or proof of their shipment.
The refund will be made using the same payment method used for the purchase, unless expressly agreed otherwise.
7. Subscriptions and Recurring Purchase Options
In the case of purchase options associated with subscription plans, the customer may cancel the subscription at any time, with effects for future shipments, provided the request is made at least 15 days in advance of the next billing/shipping date.
Cancellations made after this period do not affect the cycle already in processing.
